1. Agreement to Terms

Argusmetrics ("Software", "we", "us", or "our") is free, open-source, self-hosted web analytics software distributed under the GNU Affero General Public License v3.0 (AGPL-3.0). By downloading, installing, running, or using the Software, you agree to be bound by these Terms of Service ("Terms") as well as the terms of the AGPL-3.0 license. If you do not agree to these Terms, please do not use the Software.

These Terms describe the relationship between you and the authors/maintainers of the Software. We do not host, operate, or provide a managed service, account, or subscription. You run the Software yourself on infrastructure you control.

2. Description of the Software

Argusmetrics is privacy-first web analytics software that you self-host. It provides:

  • Website traffic analytics and statistics
  • Custom event tracking
  • Conversion goal monitoring
  • Team collaboration tools
  • API access for data integration

The Software is developed on a best-effort, voluntary basis. We may modify, discontinue, or stop maintaining the Software (or any part thereof) at any time with or without notice. Because you run your own instance, any deployment you operate continues to run under your control.

3. Self-Hosting & Operation

3.1 Running the Software

There is no registration, account, or sign-up with us. To use Argusmetrics, you obtain a copy of the source code from the project repository and deploy it on infrastructure you own or control. When operating the Software, you should:

  • Be at least 16 years old, or have appropriate authorization
  • Comply with the terms of the AGPL-3.0 license
  • Keep your own deployment, credentials, and infrastructure secure
  • Apply updates and security patches as you see fit

3.2 Operator Responsibilities

As the operator of your own instance, you are solely responsible for:

  • All activity that occurs on the instances you deploy
  • Securing and maintaining the confidentiality of your own credentials and data
  • The availability, backups, and security of your deployment

4. Acceptable Use Policy

4.1 Permitted Use

You may use Argusmetrics to track analytics on websites you own or have permission to monitor. You may also modify and redistribute the Software in accordance with the AGPL-3.0 license.

4.2 Prohibited Activities

When using the Software, you agree NOT to:

  • Use the Software for any illegal purposes
  • Violate any applicable laws or regulations
  • Track websites you don't own without permission
  • Use the Software to collect personal data without a lawful basis or consent
  • Redistribute the Software in violation of the AGPL-3.0 license terms
  • Remove or misrepresent copyright, license, or attribution notices
  • Use the project name or trademarks in a misleading way

⚠️ Note: Misuse of the Software is your responsibility. Violating the AGPL-3.0 license terminates the rights it grants you to use, copy, modify, and distribute the Software.

5. License & Cost

5.1 Free & Open Source

Argusmetrics is provided free of charge. There are no paid tiers, usage limits, fees, or any financial relationship with us. We do not bill you, process payments, or maintain any account on your behalf.

5.2 AGPL-3.0 License

The Software is licensed under the GNU Affero General Public License, version 3.0 (AGPL-3.0). Your use, copying, modification, and distribution of the Software is governed by that license. Key obligations include:

  • You may run, study, modify, and share the Software freely
  • If you distribute the Software or make a modified version available over a network, you must offer the corresponding source under the AGPL-3.0
  • You must preserve copyright and license notices
  • The Software is provided with no warranty (see Section 9)

In the event of any conflict between these Terms and the AGPL-3.0, the AGPL-3.0 governs your rights to the Software's source code.

6. Data & Privacy

6.1 Your Data

Because you self-host Argusmetrics, all analytics data stays on infrastructure you control. We never receive, access, or store your data. You retain full rights to your data and can export or delete it at any time from your own instance.

6.2 Privacy Compliance

As the operator of your own instance, you are responsible for ensuring your use of Argusmetrics complies with applicable privacy laws (GDPR, CCPA, etc.). Our Privacy Policy explains how the Software is designed to handle data.

6.3 Data Retention

  • Retention is configured by you, the operator of your instance
  • You can delete data anytime from your own dashboard
  • Deletion behavior is determined by your deployment and configuration

7. Availability

We do not host or operate any service for you, so we make no uptime or availability commitments. The availability, performance, and reliability of any Argusmetrics instance depend entirely on the infrastructure and configuration you (or your chosen host) provide.

We are not liable for any damages resulting from interruptions, downtime, or failures of an instance you operate.

8. Intellectual Property

The Software, including its source code, design, and content, is copyrighted by its authors and licensed to you under the AGPL-3.0. Subject to that license, you are free to copy, study, modify, and redistribute the Software.

Notwithstanding the rights granted by the AGPL-3.0, you must:

  • Preserve all copyright, license, and attribution notices
  • Comply with the source-availability obligations of the AGPL-3.0 when you distribute or network-serve the Software
  • Not use the "Argusmetrics" name or logo to imply endorsement of a fork or modified version

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The Software is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, as disclaimed by the AGPL-3.0
  • We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Software
  • Because the Software is provided free of charge, our total aggregate liability is limited to the fullest extent permitted by law (and, where permitted, to zero)
  • We are not responsible for data loss; you should back up important data on your own instance

10. Indemnification

You agree to indemnify and hold harmless the Argusmetrics authors and maintainers from any claims, damages, or expenses arising from:

  • Your use or operation of the Software
  • Your violation of these Terms or the AGPL-3.0
  • Your violation of any third-party rights
  • Data you collect using the Software

11. Termination

11.1 By You

You may stop using the Software at any time. Because you self-host, you remain in control of decommissioning your instance and your data.

11.2 License Termination

We do not control your instance and cannot suspend it. However, the rights granted to you under the AGPL-3.0 terminate automatically if you:

  • Violate the terms of the AGPL-3.0 license
  • Fail to comply with the obligations in these Terms

License reinstatement is governed by the terms of the AGPL-3.0.

11.3 Effect of Termination

Upon termination of your license, you must cease using and distributing the Software. The no-warranty and liability provisions of these Terms survive termination. Your own data remains entirely under your control on your own infrastructure.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via:

  • Updates published in the project repository
  • Posting on our website

Continued use of the Software after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Sweden. Any disputes shall be resolved in Swedish courts.
