Terms of Service

1. Agreement to Terms

Argusmetrics ("we", "us", or "our") is privacy-first web analytics. It is available in two ways, and these Terms cover both:

• The hosted service. We operate Argusmetrics at argusmetrics.io. You create an account, we run the servers, and we store the analytics data your websites send us. Sections 3 to 8 apply to you.
• The source code. Argusmetrics is licensed under the GNU Affero General Public License v3.0 (AGPL-3.0) and the source is public. If you run your own copy, your instance is yours: we do not operate it, cannot see it, and provide it with no warranty. Only the AGPL-3.0 terms apply to that use.

By creating an account or otherwise using the hosted service, you agree to these Terms. If you do not agree, please do not use the service.

2. Description of the Software

Argusmetrics measures website traffic without cookies and without collecting personal data about your visitors. It provides:

• Website traffic analytics and statistics
• Custom event tracking
• Conversion goal monitoring
• Team collaboration tools
• API access for data integration

The hosted service is provided on a best-effort basis. We may modify or discontinue features, and we do not guarantee uninterrupted availability. You can export your data at any time from the dashboard, and you may close your account whenever you like. If we ever discontinue the hosted service, we will give you reasonable notice and an opportunity to export your data before it is deleted.

3. Your Account

3.1 Registration

Using the hosted service requires an account. We ask for an email address and a password, and we verify the email address before the account becomes active. When using the service, you agree to:

• Be at least 16 years old, or have appropriate authorization
• Give an email address you actually control
• Keep your password confidential, and tell us if you think it has been exposed
• Only add websites you own or are authorized to measure

3.2 Operator Responsibilities

As the operator of your own instance, you are solely responsible for:

• All activity that occurs on the instances you deploy
• Securing and maintaining the confidentiality of your own credentials and data
• The availability, backups, and security of your deployment

4. Acceptable Use Policy

4.1 Permitted Use

You may use Argusmetrics to track analytics on websites you own or have permission to monitor. You may also modify and redistribute the Software in accordance with the AGPL-3.0 license.

4.2 Prohibited Activities

When using the Software, you agree NOT to:

• Use the Software for any illegal purposes
• Violate any applicable laws or regulations
• Track websites you don't own without permission
• Use the Software to collect personal data without a lawful basis or consent
• Redistribute the Software in violation of the AGPL-3.0 license terms
• Remove or misrepresent copyright, license, or attribution notices
• Use the project name or trademarks in a misleading way

5. License & Cost

5.1 Free & Open Source

Argusmetrics is provided free of charge. There are no paid tiers, usage limits or fees, and we do not bill you or process payments. We do not ask for card details, and there is nothing to cancel beyond closing your account.

5.2 AGPL-3.0 License

The Software is licensed under the GNU Affero General Public License, version 3.0 (AGPL-3.0). Your use, copying, modification, and distribution of the Software is governed by that license. Key obligations include:

• You may run, study, modify, and share the Software freely
• If you distribute the Software or make a modified version available over a network, you must offer the corresponding source under the AGPL-3.0
• You must preserve copyright and license notices
• The Software is provided with no warranty (see Section 9)

In the event of any conflict between these Terms and the AGPL-3.0, the AGPL-3.0 governs your rights to the Software's source code.

6. Data & Privacy

6.1 Your Data

When you use the hosted service, your analytics data is stored on our servers. It stays yours: you can export it as CSV or JSON at any time from the dashboard, and deleting a website or closing your account deletes the data belonging to it. We do not sell it, share it with advertisers, or use it to build profiles.

Exactly what we hold is set out in our Privacy Policy. In short: an email address and a password hash for your account, and for your visitors, page paths, referrers, country, device and browser type, plus a visitor hash built from a salt that changes daily. We never store your visitors' IP addresses.

6.2 Privacy Compliance

As the operator of your own instance, you are responsible for ensuring your use of Argusmetrics complies with applicable privacy laws (GDPR, CCPA, etc.). Our Privacy Policy explains how the Software is designed to handle data.

6.3 Data Retention

• Retention is configured by you, the operator of your instance
• You can delete data anytime from your own dashboard
• Deletion behavior is determined by your deployment and configuration

7. Availability

The hosted service is provided free of charge and without an uptime guarantee or service level agreement. We aim to keep it available and to avoid losing data, but we do not promise uninterrupted service, and we are not liable for damages resulting from downtime, interruptions or data loss.

Because tracking depends on a script running on your own website, gaps can also come from changes on your side, from ad blockers, or from visitors' browser settings. We recommend exporting anything you need to keep.

If you run your own instance instead, its availability and reliability are entirely yours: we neither operate nor monitor it.

8. Intellectual Property

The Software, including its source code, design, and content, is copyrighted by its authors and licensed to you under the AGPL-3.0. Subject to that license, you are free to copy, study, modify, and redistribute the Software.

Notwithstanding the rights granted by the AGPL-3.0, you must:

• Preserve all copyright, license, and attribution notices
• Comply with the source-availability obligations of the AGPL-3.0 when you distribute or network-serve the Software
• Not use the "Argusmetrics" name or logo to imply endorsement of a fork or modified version

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Software is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, as disclaimed by the AGPL-3.0
• We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Software
• Because the Software is provided free of charge, our total aggregate liability is limited to the fullest extent permitted by law (and, where permitted, to zero)
• We are not responsible for data loss; you should back up important data on your own instance

10. Indemnification

You agree to indemnify and hold harmless the Argusmetrics authors and maintainers from any claims, damages, or expenses arising from:

• Your use or operation of the Software
• Your violation of these Terms or the AGPL-3.0
• Your violation of any third-party rights
• Data you collect using the Software

11. Termination

11.1 By You

You may close your account at any time. Doing so deletes your account and the analytics data belonging to your websites. Export anything you want to keep first, since deletion cannot be undone.

11.2 License Termination

We may suspend or close an account that abuses the service. Separately, the rights granted to you under the AGPL-3.0 for the source code terminate automatically if you:

• Violate the terms of the AGPL-3.0 license
• Fail to comply with the obligations in these Terms

License reinstatement is governed by the terms of the AGPL-3.0.

11.3 Effect of Termination

Upon termination of your license, you must cease using and distributing the Software. The no-warranty and liability provisions of these Terms survive termination. Your own data remains entirely under your control on your own infrastructure.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via:

• Updates published in the project repository
• Posting on our website

Continued use of the Software after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Sweden. Any disputes shall be resolved in Swedish courts.
